THE Vale of Glamorgan Council have sought to clarify a notice issued to the Aviva biomass plant last month, relating to the firm's permission to continue construction works outside of restricted hours.

The council issued a control of pollution act notice to the company on September 28, restricting the hours of noisy work at the site.

The statement reads: "Works at the biomass plant are allowed to continue outside of the restricted hours, on the provision that the noise is not disturbing residents at their properties."

Some nearby residents had complained that noisy construction work was ongoing at hours outside of those permitted, however the Vale council said that they had received "no substantiated complaints."

The council also highlighted that there may have been an alternative source of recent loud noises in the area.

"From 10pm on Saturday, October 7 until 6am on Friday, October 13, Network Rail have been undertaking track improvements in the Barry area, so noise experienced during this time may have been from the railway track."

A spokesman for Aviva said that they were abiding by current restrictions.

"It seems there is incorrect information circulating locally that the project has been served an enforcement notice from the council to stop work outside of normal working hours.

"This is not the case – the local planning officer has issued a control of pollution act notice, which requires us to keep noise to a minimum outside of normal working hours, a request we are complying with."
